Privacy Policy

1. Identification of the Controller

1.1. This website is owned and managed by ONE BEST, Lda (hereinafter referred to as 'OB'), the Data Controller, with VAT number 514694602 and registered office at Rua do Paraíso 192, 4000-375 Porto, Portugal.

1.2. By using this website, you are consenting to the terms described in this Privacy Policy (“Policy”).

1.3. Despite the need to read this document, you should also refer to the Terms & Conditions available on the website, which explain the objectives of this website, our mission, and how, through interaction, we may collect your personal data.

2. Processing of Personal Data

2.1. The National Law on the Protection of Personal Data (Law No. 58/2019, of August 8, hereinafter "LPDP") and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, hereinafter "GDPR") ensure the protection of individuals with regard to the processing of personal data and the free movement of such data.

2.2. In legal terms, personal data is considered as any "information relating to an identified or identifiable natural person ('the data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, electronic identifiers, or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person."

2.3. The personal data collected and processed by OB are those voluntarily provided through various data capture methods on the website, i.e., through different user interaction moments explained in the Terms and Conditions. However, providing this information may be necessary for accessing or obtaining certain personalized informational content or services.

2.4. The categories of personal data collected will differ depending on the user's interaction with this website and their interests during each visit.

2.5. Under no circumstances will personal data about racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data related to health and sexual life, genetic data, biometric data, or data related to life or sexual orientation be requested unless, in specific instances where such information may be requested, the data subject expressly and freely consents to its disclosure.

2.6. OB will not disclose the personal data provided through this website to third parties (OB Partners) without the prior consent of the data subject.

2.7. This consent, as you will see whenever requested, for various purposes, will always be free, express, and substantiated by a clear and unequivocal positive act. Nevertheless, we will strive to make the provision of consent as easy as its withdrawal, if desired by the user.

2.8. OB cannot be held responsible for the user entering personal data of third parties to receive any commercial contact.

2.9. OB may, however, disclose this data to fulfill legal obligations or as part of subcontracting relationships established for its own purposes, always subject to adequate guarantees, without your authorization.

2.10. By accepting this Privacy Policy, the user gives their informed, express, free, and unequivocal consent for the personal data provided through the website to be included in a file under OB's responsibility, whose processing complies with the legislation on the protection of personal data and includes appropriate technical and organizational security measures.

2.11. OB maintains this database containing the records of users who provide their personal data, which is collected and processed automatically by OB.

3. Purpose of Personal Data Processing

3.1. OB focuses on creating informative, diverse content with simple and accessible language, publishing useful and relevant content monthly, using differentiated content strategies and creative orientation. Starting with the visibility of its website, it publishes sponsored content and interacts with the user, collecting personal data. The purpose of collecting and processing personal data will be direct marketing, for itself and third parties, and/or market research.

4. Direct Marketing and Communication of Data to Third Parties

4.1. By checking the box and clicking the "Accept" button (or equivalent) on the forms, you are consenting to receive electronic direct marketing communications and/or market research.

4.2. These electronic communications may be made by email, telephone, mobile phone, SMS/MMS, push notifications, or messages in chat applications (Whatsapp, Messenger, Skype, etc.).

4.3. Communications will be made by OB or its Partners (when allowed), and they may use the data provided for the same direct marketing purposes.

4.4. OB's "Partners" are legal entities, public or private, for-profit or non-profit, and are generally identified at the time of registration or, if not, belong to the categories indicated at the time of registration, listed here: • Science, Technology, and Telecommunications • Education, Training, and Employment • Non-Profit Entities • Real Estate • Health, Well-being, and Food • Tourism and Travel • Culture, Entertainment, and Leisure.

4.5. OB believes it is clearer for the user to know the categories of its Partners rather than the name of each Partner, as, with just the name, the Data Subject would only be able to know the type of advertising consented to with disproportionate research effort. However, if you want more information about each category of Partners, you can contact us, and we will promptly disclose the list of Partners.

5. Exercise of Rights

5.1. To exercise the right of access, rectification, erasure, restriction, portability, and objection, you must send an email to onebest.porto@gmail.com. In exercising these rights, you must specify the intention, which will be promptly addressed within the legal deadlines if the identity of the data subject is confirmed.

5.2. In the specific case of wanting to exercise the right to object, ceasing to receive marketing communications at any time, you can do so in the following ways: • Clicking on the link for this purpose (usually labeled "unsubscribe") in any email message you receive due to your registration on this website; • Sending an email to onebest.porto@gmail.com; • Or by postal mail, to the address indicated at the beginning of this Privacy Policy.

6. Security

6.1. OB uses adequate security measures to protect your personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure, or access, and against any other unlawful form of processing, taking into account the current state of technology, the nature of the stored data, and the risks to which it is exposed.

6.2. OB ensures the confidentiality of the data that may be provided because they are inserted into a secure server (with SSL Certificate) that encrypts/codes them. You can verify that your browser is secure if the padlock symbol appears or if the address starts with https instead of http.

6.3. However, as the Internet is not entirely secure, we warn that your personal data may circulate on open networks, without security conditions and to which OB is not related, and cannot be held responsible,

7. Data Retention

7.1. Your data is retained by OB for the purposes described here, to verify your registration on this website and to verify the exercise of your rights, within the permissible deadlines according to the guidelines of supervisory authorities.

8. Other Considerations

8.1. OB is not responsible for any acts or omissions of third parties, especially regarding links to other websites and their content.

8.2. In the event of a merger, split, transformation, dissolution, or insolvency of the commercial company OB, your data may be transmitted to third parties as a commercial asset, always in compliance with applicable law and maintaining your rights as a data subject, especially regarding consent given and the rights of opposition, access, rectification, erasure, restriction, and portability.

8.3. In case of legislative or commercial changes, OB reserves the right to change this Policy at any time, so you should consult it whenever you use this website.

8.4. For more information, please contact us by email at onebest.porto@gmail.com.
